Thank you for choosing Wildlife Dominion Management LLC (“WDM”) and/or one of our partner companies and products. Carefully read these Terms of Use (“Terms”) so you will understand how our sites and platforms operate (“sites”), what we offer, and how we can work together. Please also read our Privacy Policy. Using WDM sites and platforms, constitutes the user agreeing to the Terms and Conditions and Privacy Policy at the time of you visit. If you choose not to agree to the Terms and Conditions and/or the Privacy Policy, you must refrain from using any of the WDM sites and platforms. WDM sites and platforms are only available to users who can form legally binding contracts/agreements with Wildlife Dominion Management LLC including affiliates and partner companies. These “Terms and Conditions” are in conjuncture with the “Privacy Policy” of WDM and the user must submit to both documents.
About Us
WDM offers Web Portal(s) and associated Mobile Applications, which are used to receive notifications, view snap shots, view live video, review recorded videos, and potentially operate a Third-Party device(s).
Our Customers
The “site” is open to anyone; however, services are only available to registered user (“User”). Visiting the site, even without registering, WDM will consider you a “user”.
Responsibilities of User(s)
The information you provided WDM is true and accurate to your ability when you register to become a user.
User has/have given a valid email address, WDM may choose to confirm upon registration, or any time thereafter, via a conformation email which may require an action/response to complete registration or remain “active”.
User will notify WDM if something within this information changes.
User will/is not breaking any applicable laws when using WDM products, services, and platforms.
User will not violate any of these “Terms” as a User.
If you so choose to become a User, you are responsible for the content and activities of their account. Protecting their information and property and sites of WDM with a secure password, and not sharing passwords is the responsibility of the User. WDM recommends using passwords with a combination of numbers, symbols, and upper- and lower-case letters to create a secure login.
WDM reserves the right to terminate user access at any time (even if a payment is current or prepaid), without warning for any or no reason, with or without prior notice of explanation without liability, and can seek legal actions if deemed necessary. Users who infringe the intellectual property rights of others, including WDM property will be terminated and are subject to legal action(s). Additionally, users who commit illegal acts using WDM products, sites, or platforms can/may have their accounts terminated, suspended, restricted, or denied access. Users will be held responsible for any and all damages to WDM or others from activities deemed illegal or to violate these Terms.
Pricing and Service Plans
Users can visit and register on a WDM site with no cost.
Users will incur a monthly cost as a paying “owner” of an organization.
Said cost cover access to mobile data and service to applicable platforms and apps.
Data/Service plans will start on the same date as original purchase for the life of the membership, and are automated monthly purchases. Suspension of services and subsequent reactivation could change said date.
Suspension of data/service fees can be achieved through the signup portals of the corresponding product site and is the responsibility of the user. Users requesting suspension of data/service via email or other messaging can not be guaranteed as verification of identity is required.
Content and Data Limits
Users who are paid organization owners are allowed nearly unlimited viewing with their monthly subscription; however, downloading videos will consume larger amounts of data and can/will consume your monthly data allowance. The amount of data is regulated by WDM and products and services have specific data triggers to prevent excessive data consumption. WDM can/will store snapshot, notification, and video archives for a period of 2 weeks before said items are no longer available. It is the responsibility of the user to retrieve said data if desired. Monthly data/service fees are for a period of 30 days. WDM is not responsible for failed transactions for reoccurring data/service fees.
Content Privacy
Users retain the rights to any content they submit, upload or display on any WDM site, product, or platform. WDM its partners and affiliates, reserve the right to use content for process such as marketing, product research, and advertising. WDM its partners and affiliates will make reasonable efforts to protect the privacy of its users, and its data. Users are responsible for any activity deemed illegal by governing agencies or organizations and judicial officials.
User content is considered private and not visible to other users or the public Internet.
It is considered a misuse by WDM to provide user credentials publicly and doing so may result in termination of your account and removal of your content.
Providing direct links to WDM sites or your content is prohibited.
Users allowing your camera to upload content (photos and videos), users are confirming that content is their property, and the uploading and use of content does not violate the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights, or human rights of someone else. WDM has the right to remove any and all content, if it is deemed that you are violating any of these rights. User is responsible for any and all costs associated with these infringements.
WDM may moderate and use content as stated above. However, WDM is not responsible for content you upload and are/is under no obligation to modify or remove any inappropriate content.
Users who choose to suspend or allow their account to go inactive, WDM is under no obligation to keep or store their content beyond the termination of said data/service time.
WDM owns, leases, and licenses the software to create the website, apps, and platforms; these are property of WDM and may not be copied, publicly displayed, reproduced, or be recreated.
WDM Webmasters and IT technicians reserve the right to investigate issues and/or problems during the course of normal business operations. This may allow your content and privacy to become visible to WDM and third-party partners. WDM will take every precaution to maintain your privacy and content during these processes.
Important Guidelines
Terms and the Privacy Policy can change, WDM may announce any “large” changes, however your use of the products, websites, apps, and platforms after the change, regardless of user being aware of the changes does constitute user agreement to the changes.
WDM is a US based company and user usage in “other” countries may offer you fewer protections and rights.
Downloading of software, using the websites, apps, products, and platforms is the sole risk of the user.
WDM and these Terms are governed by, and interpreted in keeping with, the laws of the State of Mississippi. Users agree to submit to the exclusive jurisdiction of the courts located within the State of Mississippi to resolve any dispute that may arise. Users herby knowingly, voluntarily and intentionally waive any right it may have to a trial by jury in respect of any litigation (including but not limited to any claims, counterclaims, cross-claims, or third-party claims) arising out of, under or in connection with the term and agreement policy. Further, each party hereto certifies that no representative or agent of either party has represented, expressly or otherwise, that such party would not in the event of such litigation, seek to enforce this waiver of right to jury trial provision. Each of the parties acknowledges that this section is a material inducement for the other party entering into this agreement. User further agrees to arbitration at their expense, to attempt settlement of any issues, prior to any legal filings.
Users acknowledge the use of the “sites” is at their own risk and the services are provided “AS IS”.
WDM is not implying the “sites” will meet any of your specific needs or that you will obtain particular results if using said “sites”.
WDM encourages the user to save content independently of WDM “sites”. WDM is not responsible if content is deleted, modified, suspended, or discontinued due to a malfunction or disruption in services.
WDM will make effort to keep the “sites” up and running and accessible at all times. WDM is not responsible for any errors, omissions, interruptions, deletions, defects, delays in operation or transmissions, communications failures, theft or destruction or unauthorized access to, or alteration of, any user communication. This includes but not limited to; results of maintenance of “sites” or any problems or malfunctions of any network, servers, software, equipment, internet traffic, or any other failure of any nature.
WDM is not responsible for advertisements or applications or services that are/may be posted on our “sites”. Nor does WDM have any responsibility for the goods and services provided by advertisers, third-party or via the websites or applications including our vendors.
WDM evaluates data usage and provides actual data amount per billing cycles via independent cellular and satellite wireless carriers. Actual data usage will vary based on network conditions including capacity and coverage of data providers. Users should be aware that firmware updates to their camera can be done via cellular and satellite networks and can affect data allowances.
WDM Limitation of Liability
These Terms and our Privacy Policy are binding contract and the user needs to acknowledge the following.
LIMITATION ON LIABILITY. IN NO EVENT SHALL WDM BE LIABLE TO THE USER OR ANY THIRD-PARTY FOR ANY INDEIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT DAMAGES ARISING FROM USE OF THE WDM “SITES” AND SERVICES, EVEN IF WDM HAD BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOT WITH STANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, WDM’S LIABILITY TO THE USER FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY THE USER FOR SERVICE FEES DURING THE BILLING CYCLE TERM OF THE MONTH.
User (“Your”) Indemnity to WDM (“Us”). If the user (“you”) breach any of the representation made herein regarding user rights in the content, or your uploading of content violates any of the promises/agreements you have made, you agree to indemnify, defend and hold WDM, its subsidiaries, and affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable and all attorneys’ fees, made by any third-party due to or arising out of your use of the “site” and services in violation of that and/or arising from any content that you post on or through the “sites” and services, and through any and all other sites on the internet or in print.
User obligations continue event after you terminate the user agreement and/or services of WDM. Even if the user terminates his/her account and services or WDM terminates user services and membership, user is still held responsible for indemnifying WDM for any breaches that took place while using WDM “sites” and services. Obligations the user owes to WDM, which survive the terminations, will survive under these Terms and Agreements.
GPS Data
GPS data is provided to users with the understanding, there are no guarantees of accuracy and/or reliability. WDM and any affiliates shall not be held liable for any errors or inaccuracies of information received or used through GPS services. GPS information is provided by WDM with implied or expressed purpose of use. Liability for any and all claims or losses resulting from the use of GPS data lies solely with the user.
Audio Recordings
WDM provides audio recordings on some devices. Audio features are not intended for use of surveillance purposes. Audio recording of individuals is strictly covered by laws that are different across the United States and other Countries. WDM products should never be, and are not intended to be, used to record the conversations between two or more people. User is advised that unlawful use of the Audio Recording feature can result in criminal prosecution of the user depending on the state. Punishments for such activities can result in misdemeanor and/or felony charges and punishment can range from fines to imprisonment, depending on the state and country. Information in the document is subject to change without notice and should not be construed as any commitment by Wildlife Dominion Management LLC, including any affiliates and partners. WDM further assumes no responsibility for errors that may appear in this document. Wildlife Dominion Management LLC, including any affiliates and partners shall in NO event be liable for incidental or consequential damages arising from the use of WDM products, websites, apps, and platforms (“sites”) described but not limited to this document/agreement.
